1. Acceptance of Terms

InsiteGPT is a product of Bhavitech Softwares Private Limited. By accessing or using InsiteGPT ("the Service"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Service. These terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

InsiteGPT provides an AI-powered customer support and lead generation platform that allows businesses to deploy intelligent agents trained on their existing knowledge base. Features include knowledge base sync, lead capture, human escalation, white-label deployment, and third-party integrations.

3. Account Registration

To use InsiteGPT, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access or breach.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Transmit harmful, offensive, or misleading content
• Infringe the intellectual property rights of others
• Attempt to gain unauthorized access to any part of the Service
• Use automated tools to scrape or extract data from the platform
• Resell or sublicense the Service without prior written permission
• Abuse or overload the platform in a manner that degrades service quality for other users

5. Intellectual Property

All content, features, and functionality of InsiteGPT — including but not limited to text, graphics, logos, and software — are the exclusive property of Bhavitech Softwares Private Limited and are protected by applicable intellectual property laws. You retain full ownership of the content you upload to train your AI agents.

6. Subscription and Billing

InsiteGPT offers paid subscription plans billed on a monthly or annual basis. By subscribing, you authorise us to charge your payment method at the start of each billing cycle. Subscriptions auto-renew unless cancelled before the renewal date.

All billing and payment processing is handled by Paddle.com, our authorised Merchant of Record. By subscribing, you also agree to Paddle's terms of service available at paddle.com/legal. Paddle is responsible for processing payments, issuing invoices, and handling applicable tax compliance globally.

You may cancel your subscription at any time from your account settings. Upon cancellation, you will retain access until the end of the current billing period.

7. Third-Party Services

InsiteGPT integrates with third-party services including but not limited to OpenAI, Slack, Zendesk, Salesforce, Notion, and Google Drive. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the actions, data practices, or availability of third-party services.

InsiteGPT uses a Bring Your Own Key (BYOK) model for AI processing. Your OpenAI API usage is billed directly by OpenAI to your account and is governed by OpenAI's terms and usage policies.

8. Fair Use

You agree to use the Service in a manner consistent with its intended purpose. Excessive automated usage, sharing of account credentials, or behaviour that degrades platform performance for other users may result in account suspension without prior notice.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, Bhavitech Softwares Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount paid by you in the three months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms of Use. You may also terminate your account at any time. Upon termination, your right to use the Service will immediately cease. We will retain your data for 30 days post-termination before permanent deletion.

12. Changes to Terms

We may update these Terms of Use from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised terms. We will notify you of material changes via email or through the platform.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
